I'd like to call a special work session meeting into order yes sir thank you so we will begin our review of our policies and procedures tonight we will go fast so if we do have uh questions please let me know we do have 40 policies in 12 procedure changes and we will start with our policies the first policy is a legal change due to House Bill 319 that amends KRS 160.30 to require that when a vacancy occurs the superintendent shall submit the job posting to the Statewide job posting system there are no financial implications this is a Personnel certified hiring policy policy zero 3.11 it is four pages with one small edit under the superintendent responsibilities under paragraph two that states when a vacancy occurs the superintendent shall submit the job posting to the Statewide
job posting system and it deletes the words notify the commissioner of Education the second policy is a legal policy it is due to a recent case per Smith versus Bennett and it states when a teacher has attained continuing service contract status in one district and becomes employed in another District the teacher shall retain that status however a district may require a one-year probationary period of service in that District before granting that status the continuing service contract status of a teacher shall be terminated when the teacher leaves employment all provisions of KRS 161.7202 161.810 to the contrary notwithstanding and the continuing service contract status shall be transferred to the next school district for a period of up to seven months from the time of the employment in the first school district that was terminated there are
a couple of financial implications which is Teachers obtaining tenure in a district this policy is a Personnel it is a certified Personnel transfer of tenure policy which is zero three point one one five and it states as follows the continuing service contract status of a teacher shall not be terminated when the teacher leaves employment all provisions of KRS 161.720 to KRS 161.810 to the contrary notwithstanding and the continuing service contract status shall be transfer to the next school district of a period of up to seven months from the time employment of in the first school district has terminated and then it references the krs's below it's only one page policy are there any questions on the first two policies all right the next one is a legal due to House Bill 331 it amends krs-158.162
to require the district to maintain a portable automated external defibrillator in every middle and high school building and as funds become available at every school sanctioned middle and high school athletic practices and competitions and to adopt procedures for the use of aeds during emergencies it also requires all intra Scholastic athletic coaches to be trained in the use of portable aeds and maintain a CPR certification recognized by the national accredited body of the heart of excuse me body on health heart health the financial implications are of course the cost of purchasing and maintaining aeds and copying and distributing plans and Personnel training costs this is a Personnel certified Personnel policy for coaches and assistant coaches and it is 03.1161 you're going to hear this repeated several times I'm not going to read the whole thing unless
you suggest that I do when is repeated I will state it will be the AED policy okay because you'll hear several times it is not funded and the health department is partnering with us and is going to help us with some of those yes and Mr field has done a real good job of already starting that process so the um the purchasing of those of course is the expense but also he's working on the plan the plan has to be in place and of course the cost of training as well this is what it adds in it does take out CPR and adds in cardio pulmonary resuscitation all the way through so you're going to see that I won't repeat that every time I'll just say the CPR edit and then it does have an
add-in of all interscholastic athletic coaches shall maintain a CPR certification recognized by national accrediting body on heart health and it references the KRS the next policy is legal due to Senate Bill seven it's effective now and amends krs-336.134 to prohibit districts from deducting money from the employee payroll for the certain purposes districts shall no longer deduct any amount for any dues fees assessments or other charges to be held for transferred to or paid over to a labor organization or political activities It also says to know that Senate Bill 7 amends KRS 161.158 to reflect the following the District board is prohibited from deducting membership dues out of an employee organization membership organization or labor organization there is a strikeout of just the word of without expressing written consent from the employee of course the only
financial implications is the time spent removing all those payroll deductions and this is a Personnel certified so you can also hear this in the classified section this is the the policy salary deductions which is policy zero 3.1211 and it basically literally removes a section of that um policy that states deductions for membership dues of employee organization section so it basically just removes that section it's a deduction not an add-in any questions on that the next one is Lego House Bill 319 due to House Bill 319 removes the requirement that an affidavit would be submitted for sick and personal leave and replaces the affidav with the statement there are no financial implications this is a Personnel certified personal leave policy zero three point one two three one um you all know a couple of years ago
this was a requirement for certified and classified Personnel so this is replacing the word affidavit with the word statement and you're going to see that throughout all of the policies and you're also going to see that um it states that if there is someone that works less than full-time that you're going to see whatever that time is it's going to be calculated to the nearest one-half day okay so you're going to see that throughout each one of these as well otherwise all you're going to see is the replacement of the word affidavit with the word statement any questions on that the next one is is a legal House Bill 319 removes the requirement that an affidavit be submitted for sick and personal leave and replaces the affidav this is Personnel certified Personnel sick leave policy
zero three point one two three two again those same edits with the word uh one half day and replacing the word affidavit with the word statement any questions the next one is legal due to House Bill 547 creates a new section of KRS KRS 158 which permits a school district employee on duty to engage in religious Expressions otherwise protected by the First Amendment to the United States Constitution there are no financial implications this is Personnel certified and the title is employee religious expression it is policy zero three point one three two four one I'm going to read it in its entirety because it's brand new it's too pain just bear with me or a page and a half on duty per KRS 158.193 on duty means those times when an employee is one required by
the district to be on campus at or another designated location are required to perform the scope of employees duties or to otherwise acting as a designated representative of the district the district shall not punish or prohibit an employee from or punish an employee for engaging in private religious expression otherwise protected by the First Amendment to the United States Constitution absent is showing that the employee has engaged in actual coercion employee May while an employee is on duty the employee May at a minimum one engage in religious expression and discussion and share religious materials with other employees at the same time in the same manner that employees are permitted to engage in non-religious expression and discussions outside of the scope of Duties to engage in private religious expression at a time when it is otherwise permissible
for an employee to engage in private expression conduct or act outside of the scope of Duties three meet with other District employees for prayer or religious study during times that the employee is allowed to act outside of the scope of Duties including but not limited to the employee breaks time before school and during lunch four work as a sponsor of a student religious club or organization and assist students in planning meetings activities and events to the same extent that the employee sponsors of non-religious clubs or organizations are permitted to do so five where religious clothing symbols or jewelry provided that such items otherwise comply with any dress code implemented by the district 6 decorate their desk and other personal spaces with personal items that reflect their religious beliefs to the same extent that other employees
are permitted to decorate their desk and ask excuse me and other personal spaces with personal items and seven during the non-instructional time engaging religious expression and share religious materials to the same extent that other employees May engage in private expression permitted under the First Amendment to the United States Constitution the authority States this shall not be con construed to authorize the state or any other governmental organization to One require any person to participate in prayer or any other religious activity or to violate the constitutional rights of any person this shall not be construed to limit the district's authority to one maintain order and discipline on school property in a Content neutral and Viewpoint neutral manner to protect the safety of students employees and visitors and three adopt the enforce policies and procedures regarding student speech
at school that respects the rights of students and then it references the KRS is any questions on this policy it allows it allows First Amendment rights of religious freedom to be completely allowable at school very similarly to what we currently have just not um over step um and provide more religious views through discussion so for example if you've got a class that it lends itself to that would be expected like if it's Christmas time and you're talking and doing more of a lesson on a Biblical topic that might step outside of so I think it's pretty much how we normally function now for example if a teacher wears a cross necklace that's that's completely allowable and if they wear a shirt or something that expresses their religious freedom then that would be allowable as well
as long as it doesn't step outside of that particular dress cut of that school is that helpful yes there is a lot any other questions or comments on this one this one is a new one you're going to see this one again under certified as well and so you'll see this one again okay all right the next one is legal House Bill 319 creates a new section of KRS 162 require the board to adopt a policy to ensure that District employees complete an exit survey when they voluntarily leave the district the financial implementations could be associated with the cost of the survey this is a personnel certified Personnel policy zero three point one seven the title is termination not renewal Separation by employee policy there is one add-in and then the KRS is referenced on
the second page the add-in is as follows a certified employee who voluntarily leaves the district shall complete an exit survey that includes but not limited to the position vacated the employees years of service in the position in the district if the employee is taking a similar position in another district and the reasons provided for leaving the district this information shall be reported to the Kentucky Department of Education by The District in a system developed by KDE without providing personally identifiable information any questions on that one the next one is legal House Bill 32 amends krs-161.011 to permit hiring of classified Personnel without a high school diploma if opportunity to obtain a high school equivalency diploma is provided by the district and permits certain government issued certifications or licenses to substitute the only financial implementation implications
would be potentially the cost of the associated with administering the equivalency program this is Personnel classified Personnel hiring policy policy zero three point two one there are some add-ins and some deletions under the educational requirements I will read it as it will be stated in just not read the deletions no person shall be initially hired unless he or she holds the at least a high school diploma or High School certification or certificate of completion or high school equivalency diploma or is provided an opportunity by the district upon employment to obtain a high school equivalency diploma at no cost to the employee and then it goes in and just deletes all the references to the progress toward that high school equivalency because that was the original part of the policy licenses or credentials issued by a
government entity that require specialized skill or training may also substitute for this requirement any questions on that we have in the past have had some of those so this is a good thing the next one is legal House Bill 13 it immense krs-281a 0.175 related to the physical exam required for school bus drivers it changes the required physical exam from every year to every two years of course there's less financial implications this is a Personnel policy for classified Personnel medical examination is the title and it's zero three point two one one it strikes out that original introduction which talks about the medical examinations it adds in language under bus drivers to state every two years instead of each year and then it adds in those two new krs's the other edits on this policy is
under the tuberculosis screening and it goes it it inserts the letters TB instead of tuberculosis just so you know there's a couple of those sprinkled throughout the first page as well any questions on that age and after that yeah every two years 15 seconds understand yeah I understand I was a little surprised that they changed it every two years as well truck drivers from the angel yeah all right the next one is legal due to House Bill 331 amends krs-158.162 to require the district to maintain portable automated external to the AED so the um the changes of course and this one is a Personnel classified it is the non-teaching coaches and assistant coaches which is the same as the certified coaches policy but this one is policy zero three two one four one and it
changes the CPR cardio pulmonary resuscitation language and adds in the word external defibrillator and it also adds in the following line all interscholastic athletic cultures shall maintain a CPR certification recognized by a national accrediting body on heart health and it also adds in that new KRS the next one is legal due to Senate Bill seven it's effective now uh amends krs-336.134 to prohibit districts from deducting the money from employee payroll for certain purposes um this is the classified version of that certified Personnel salary deductions policy this policy for classified a zero three point two two one one it completely deducts the following or deletes the following statement deductions for membership dues of an employee organization Association or Union shall only be made upon the express written consent of the employee the consent may be revoked
by the employee at any time by written notice to the employee so as you know that Paul that this policy just eliminates that we're not allowed to do that anymore the next one is legal due to House Bill 319 removes the requirement that an affidavit be submitted for sick and personal leave again this is the same policy for classified that we just talked about for for certified this one is Personnel classified personal leave it is policy zero three point two two three one it adds in that one half day if someone starts later that their calculation is to to the nearest one-half day it replaces the word affidavit which is no longer required now to the word statement and adds in that KRS the next one is legal due to House Bill 319 removes the
requirement that an affidavit would be submitted for a second personal leave and replaces the affidavit with a statement again this is the Personnel certified or excuse me classified Personnel sick leave policy policy zero three two two three two and just adds in that that little word one half day and the K are now and replaces the word affidavit with the word statement so this was the personally policy and this was the cyclic policy for classified the next one is is legal due to House Bill 547 creates a new section of KRS which permits a school district employee on duty to engage in religious expression otherwise protected by the First Amendment to the United States Constitution there are no Financial financial implications this is a Personnel classified policy for employee religious expression the policy is zero
three point two three two four one it is the entire policy that I just read to you for the certified if you want me to read it again all right if you have any other questions I know we've discussed it but I don't want to be repetitive but I also wanted to know that the same policy will be in place for certified and classified the next one is legal due to House Bill 319 creates a new section of KRS to require the board to adopt a policy to ensure the employees complete the exit survey when they are volunteered when they voluntarily leave the district there potentially could be a financial implication which would just be the cost of the survey this is a Personnel classified Personnel Separation by employee policy policy zero three two seven
two it's the same exact language as the certified policy that requires them to provide an exit survey the position the years of experience if they're going to another District to take a similar position why they're leaving the district and for for the district to report to KDE anonymously the um the reason why the next one is legal Senate Bill 169 amends krs-65.028 by permitting school districts to engage in public and private Partnerships with board approval financial implications could be savings and the share cost of projects it is also legal due to House Bill 522 which amends KRS 45 a 0.385 increasing the aggregate contract amount maximum for small purchases from that 30 000 to now forty thousand so the financial implications is the larger amount for small purchasing procedures so instead of that thirty thousand
dollar um amount it is increased to that forty thousand dollar amount this is a fiscal management policy called Model procurement purchasing it is policy zero four point three two the changes are the add-in and it states public private Partnerships the board May utilize a public-private partnership delivery method public private partnership shall comply with KRS 65.28 and other applicable state laws and regulations and the only other changes on the second page again it changes that 40 that thirty thousand to forty thousand and it does that in those two krs's you're going to hear that one a couple times as well the next one is legal House Bill 331 amends KRS 158.162 to require each school to have a written cardiac emergency response plan it also requires the district to maintain a portable automated AED in every
middle and high school building as funds become available at school sanction middle and high school athletic practices and competitions and to adopt procedures for the use of aeds during emergencies it also creates a new school section of krs-158 to require the district to report the number of aeds at each school to the Kentucky Department of Education financial implications of course are the cost of purchasing potentially maintaining the aeds and copying and distributing the plan in Personnel training cost this one is a school facilities policy called Safety it is policy zero five 0.4 it's a five-page policy there are minor changes on page one it just adds in the word and and then on page two it under the district school and safety coordinator it adds in well it actually removes for that person to advise
the superintendent by July 1 of each year it just is an annual it takes away that time frame it just says annually under this under superintendent to report it adds in the following language automated external defibrillators aeds the district shall maintain aeds in designated locations throughout the district and AED shall be used in emergency situations warranting its use in accordance with krs-311.665 to krs-311.669 the district shall notify the local emergency medical services system and local emergency communications or vehicle Dispatch Center of the existence location and type of each AED AED shall be kept on school property and will not accompany EMS Personnel to a hospital emergency room the next edit is on page three and it states the board shall require the school council or if none exists the principal to adopt an emergency plan
for the school that shall include procedures to be followed in cases of medical emergency fire severe weather earthquake or building lockdown as defined in KRS to a written cardiac emergency response plan and three a diagram of the facility that clearly identifies the location of each AED another add-in States the emergency plan shall be provided to appropriate First Responders which we typically do that anyway we meet with them a couple times a year and Mr Fields I don't think he's in here but he does a good job with that it does have an add-in of each school year including this the school council it adds in that school nurse so the School nurses will have a responsibility in this to review that plan as well it adds in the following statement as well the cardiac emergency
response plan shall be rehearsed by a simulation prior to the beginning of the athletic season by one licensed athletic trainers School nurses and athletic directors and two interscholastic coaches and volunteer coaches of each athletic team active during the athletic season there is some another dilation of that July 1 deadline and just as an annual and then on page four there's a lot of add-ins and I'm going to read it to you the last page page five is a huge delete of defibrillators but there's a huge add in so I'm not going to read the deletion but I'm going to read the add-in so you know what the add-in is so under School emergency planning number five states the following this is new maintain a portable AED and public readily accessible well-marked location in every middle
and high school building and as funds become available at each School sanction middle and high school athletic practices and competitions and a adopt procedures for the use of the portable AED during emergency B adopt policies for compliance with krs-311.665 to krs-311.669 on training maintenance notification and communication with the local Emergency Medical Services System C ensure that a minimum of three employees in the school in all inter Scholastic athletic coaches be trained on the use of a portable AED in accordance with krs-311.667 and D ensure that all interscholastic athletic coaches maintain a cardio pulmonary resuscitation certification recognized by by a national accrediting body on heart health and six require development of an event specific emergency action plan for each School sanctioned non-athletic event held off campus to be used during a medical emergency which may include
the provisions of a portable AED the plan shall a include a delineation of the roles of staff and emergency Personnel methods of communication and assigned Emergency Equipment including a portable AED a cardiac emergency response plan and access to and plan for emergency transport and B be in writing and distributed to any member of the school Personnel attending the school sanctioned event in an official capacity by August one of each year the superintendent shall report to the Kentucky Department of Education the number of portable aeds at each School within the district again that last page has a complete take it's a deduction a delete of defibrillators and this is a more specific plan so it just deleted this section on defibrillators any questions on that one where is it that's this yeah yeah so so there's
going to be three people that are um going to be reviewing the plan all the coaches have to be trained and everybody has to know the plan so um and then wherever the aeds are they will have to be clearly defined as to where they are and how you get to them so somebody at the game whoever's in charge a lot of times it's the athletic director um you know sometimes it'll be an assistant athletic director will know where it is how to access it and be able to get it there and then your coaches should be able to know how to utilize it I don't know Mr Fields is really working hard on this plan he's been working with different folks and gotten some samples and different things he tries to get ahead of
the game to get because this is an extensive plan I mean this is not just a plan that you're going to have a one-pager on it's going to be a pretty extensive plan so he's been working on it they may go into detail and identify specifically but we do have um our athletic director has been involved the assists and athletic directors will be involved and then once they get the plan finalized we'll run it by the board attorney get some input from him and of course review it with all those those three people that are required and then we'll roll it out to the coaches but it'll be it'll be a process to get this to get this policy um well done baseball volleyball soccer absolutely please do there is foreign thank you it is
you'll see as Mr White was referencing as part of the procedure you're going to see that checklist where that um we document where and when you know that's taken place as far as the the checking of the batteries and things like that that they already currently do there's just the procedure foreign their part is so you're going to see this policy I won't read it again unless we all want me to but we've got an extensive a lot of work to do as you all know and as Mr White said we've already gotten some of this and Mr Fields really has done a good job of trying to get a lot of things mitigated but this puts it in policy it requires a plan a pretty extensive plan and you'll you'll see I'm sure more
on that the next one is a legal due to 704 Kar 3.305 the impact on the individual learning plan performance-based credits and the early graduate program there are no financial implications anticipated this is a curriculum and instruction so we're transferring into some different types of policies this one is a graduation requirement zero eight point one one three and the ILP add-in States as fall this is a five-page plan with significant changes so bear with me okay the first page has the development of an ILP for each student shall be established within the first 90 days of school of the sixth grade year and shall be focused on Career exploration and post-secondary Education and Training needs the next Second full page is a complete deletion of the current plan and the next page gives because it's
outdated okay and then you have the actual current plan then you see on page four um it takes away the language of performance-based credits and adds in and this that says located in policy zero eight point one one three one which you'll hear me read in its entirety it has a deletion of early graduation certificate moving it again to policy zero eight point one one three one one and it also has another deletion of what is called early graduation certificate continued of a couple of paragraphs it takes out that one KRS and k-a-r and adds in to others any questions on that you're going to hear more on this these changes here in a bit the next one is legal due to revisions to 704 Kar 3.305 impact performance-based credits no financial implications anticipated this
is curriculum and instruction alternative credit policy zero eight point one one three one it is two pages and has the policy performance-based credits add in which I will read it's in in its entirety in the addition to Carnegie unit students may earn credit toward High School graduation through the District standards-based performance-based Credit system that complies with requirements of kar Kentucky administrative regulation procedures for developing and amending the system shall address the following one conditions under which each high school May Grant performance-based credits and the related performance descriptions and assessments to object objective grading and reporting procedures three content standards established in 704 Kar 3.303 and 704 Kar chapter 8 for the extent to which state provided assessments will be used five the ability for students to demonstrate proficiency and earn credit for learning acquired outside
of school or in Prior learning and six criteria two ensure that internships Cooperative learning experiences and other learning in the school and Community are a designed to further the student progress toward the individual learning plan supervised by qualified instructors and aligned with State and District content and performance standards in the add-in for the kar is below as well any questions on that one the next one is legal revisions to Kar excuse me 704 Kar 3.305 impacted the early graduation this is the one I promised a couple policies ago I'm going to read it as and it's in its entirety it's a page and a half bear with me it's a curriculum and assessment and there aren't all financial implications anticipated is early graduation program so it defines the early graduation policy this is policy zero

whichever comes first they're the only financial implications of of course the cost of ESS this is a curriculum and instruction policy called extended school services and it is policy zero eight point one three three there is an add-in in it states ESS shall be provided to eligible students who are in the first year of primary school program through 12th grade students shall be eligible to receive these Services until they graduate from 12th grade or reach age 21 years of age whichever comes first any questions on that one the next one is legal Senate due to Senate Bill 150 which is effective now this one amends KRS 158 this is a lengthy new policy and I will read it in its entirety KRS 158.1415 to require a policy to respect parental rights regarding human sexuality it
also requires parental notification of the student's planned participation in the course in a process for rent consent from the parent or Guardian there are no financial implications it is a curriculum and instruction policy on human sexuality and it is policy zero eight point one three five three one and it is such per KRS 158.1415 if a school council or if none exists the principal adopts a curriculum for human sexuality or sexually transmitted diseases instruction shell include but not be limited to the following content a abstinence from sexual activity is the desired goal for all school-aged children B abstinence from sexual activity is the only certain way to avoid unintended pregnancy sexual transmitted disease and other Associated health problems C the best way to avoid sexually transmitted disease and other Associated health problems is to establish
